Kuwait’s Deputy Director of the Fatwa and Legislation Department, Advisor Haitham Al-Ruwaid, affirmed on Tuesday the department’s commitment to enhancing the legal awareness of specialists and employees in government entities, thereby reinforcing the principles of transparency and governance.
This statement was made by Al-Ruwaid in an interview with the Kuwait News Agency (KUNA) on the sidelines of the dialogue seminar titled “The New Public Tenders Law (A Legal Reading of the New Amendments and Their Impact on Government Contracting Procedures),” which is part of the activities of the Second Legal Cultural Season of the Fatwa and Legislation Department.
Al-Ruwaid stated that the Fatwa and Legislation Department, through this seminar and its counterparts scheduled during its cultural season, aims to enhance legal awareness and empower specialists and all relevant segments, particularly those working in government entities subject to the Public Tenders Law, to gain a comprehensive understanding of its amendments. This initiative seeks to achieve the law’s objectives of ensuring flexibility in application, as well as efficiency, transparency, and fairness.
He noted that under the patronage of its Chairman, Advisor Salah Al-Majid, the Fatwa and Legislation Department continues its second cultural season by hosting its second seminar, which sheds light on the provisions of Law-Decree No. (94) of 2026 amending some articles of Law No. (49) of 2016 concerning Public Tenders. This decree includes amendments related to regulating procurement and tendering processes conducted by government entities.
He added that practical application of the law revealed several difficulties and operational issues that had negative repercussions on the workflow. Consequently, these amendments were issued to simplify procedures, address the difficulties and problems arising from practical realities, and enhance the flexibility of concerned entities in dealing with actual facts. This aims to serve the interests of work and ensure the execution of public tender procedures with speed, efficiency, transparency, and fairness, according to the explanatory memorandum of the aforementioned law.
The Legal Cultural Season of the Fatwa and Legislation Department, running until February next year, covers various topics related to legal and legislative affairs through its different seminars, as part of efforts to disseminate legal culture.
The second seminar of the season was dedicated to discussing the new Public Tenders Law, focusing on a legal reading of the new amendments and their impact on government contracting procedures. It examined the features of the new law, the main challenges it faces, the limits of coordination mechanisms between government entities, and the primary impact expected from this law on the government contracting system.
Last September, Law-Decree No. 94 of 2026 was issued to amend some provisions of Law No. 49 of 2016 concerning Public Tenders. The law aims to simplify procedures, address difficulties and problems stemming from practical realities, and enhance the flexibility of concerned entities in dealing with actual facts to serve the interests of work and ensure the execution of public tender procedures with speed, efficiency, transparency, and fairness.
