Court Orders Municipality to Issue Property Description Certificates to Enable Owners to Partition and Reserve Shares

The Court of Cassation ordered the Director General of the Kuwait Municipality, in his official capacity, to issue property description certificates for several properties, after the municipality had refused to issue them without legal justification, thereby preventing their owners from partitioning and segregating their shares.

Attorney Abdullah Mansour Al-Faraj, representative of the plaintiffs, stated that during his arguments before the court, he highlighted the municipality’s unjustified refusal to issue the certificates, urging the court to compel the municipality to issue the property description certificates for the properties subject to the lawsuit.

He added that the court accepted the defense’s requests and ordered the municipality to issue the necessary certificates to enable the plaintiffs to partition and segregate their shares, paving the way for their sale at a public auction.

Al-Faraj confirmed that the Court of Appeal upheld the ruling, making it final and enforceable.
