Health Minister Revokes License of Private Clinic for Subleasing and Unauthorized Third-Party Operation

Health Minister Dr. Ahmed Al-Awadi revoked the license of a clinic in the private health sector after it was established that the facility’s license had been subleased and exploited by third parties, in violation of the laws and ministerial decisions governing the operation of health facilities.

The decision was based on the findings of inspections and audits conducted by the Health Licensing Department, as well as a report submitted to the minister confirming that contracting parties had exploited the medical license and managed the facility, alongside the detection of several related violations.

A review of the investment contract submitted by the license holder revealed clauses defining the nature of the relationship and the obligations of the parties, thereby proving that the health facility was being operated by third parties in contravention of Article 15 of Ministerial Decision No. 36 of 2024, which prohibits the subleasing or exploitation of the facility by third parties in any form.

The decision to revoke the license relied on Paragraph 4 of Article 63 of Law No. 70 of 2020 concerning the practice of medicine and its auxiliary professions, patients’ rights, and health facilities, which stipulates the revocation of a health facility’s license if it is proven that the owner or manager has subleased or exploited the license by third parties in any form.

The Ministry of Health emphasized that enforcing the law and safeguarding the integrity of health practice represent a steadfast commitment with no room for leniency, particularly since health facilities are directly linked to human health and safety. This necessitates their compliance with established legal and professional regulations, and that operations within them be conducted exclusively by license holders and legally authorized personnel.

The Ministry stressed that its specialized teams will continue follow-up, supervision, and inspection of private sector health facilities, and will take legal measures against anyone proven to have violated or circumvented the governing regulations, in order to protect patients’ rights, enhance the quality and safety of health services, and reinforce professional and legal discipline in the health sector.
