'Al-Janah' Acquits Citizen of Fraud Charge Against Kuwaiti Woman for 40,000 Dinars

A misdemeanor court acquitted a Kuwaiti national of charges of fraud and swindling against a Kuwaiti woman, and of misappropriating 40,000 dinars.

The defendant’s lawyer, Muhammad Sati Al-Otaibi, stated that the court concluded that the elements of the crime of fraud and swindling were not established, clarifying that the incident amounted to no more than a civil dispute between the two parties.

Al-Otaibi explained that a commercial project between his client and the complainant was not completed due to reasons beyond his client’s control. Despite this, his client paid a significant portion of the amount, but later encountered financial difficulties and requested a grace period to complete the repayment. However, the complainant filed a complaint accusing him of fraud and swindling.

He added that breaching the agreement does not constitute the crime of fraud in itself, and that fraudulent means were not present, as confirmed by the victim’s statements during investigations, which further confirms that the dispute is civil rather than criminal.
