The Administrative Court Orders the Authority for Persons with Disabilities to Register Individuals Blind in One Eye

The Administrative Court ruled to annul the decision of the Technical Committee affiliated with the Public Authority for Persons with Disabilities, and ordered the Authority to register a citizen who has lost vision in one eye under the category of moderate visual impairment, granting him all rights and benefits prescribed by law.

Attorney Awatef Sulaiman Al-Dosari, representing the plaintiff, stated that the court affirmed in the reasoning of its judgment that the loss of vision in one eye constitutes moderate visual impairment in accordance with the provisions of the law and established judicial precedents, as well as the rulings of the Court of Cassation, thereby entitling the injured party to the rights and benefits guaranteed by the Law on the Rights of Persons with Disabilities.

She added that the court concluded that the Technical Committee’s decision was contrary to the law, as it ignored the approved medical reports that confirmed her client’s condition, in addition to the decision lacking any valid legal or medical justification for refusing to register him among persons with disabilities.

Al-Dosari clarified that the judgment reinforced the principle that administrative decisions are subject to judicial review, and emphasized the necessity for relevant authorities to adhere to medical reports and established judicial rulings when considering applications for the registration of persons with disabilities.

She considered the judgment a significant step in protecting the rights of individuals who have lost vision in one eye, and in strengthening the assurance that they receive their legal benefits whenever the prescribed medical and legal conditions are met.
