The Court of Appeal annuls the Applied Sciences University's decision to reject the promotion of a faculty member

The Court of Appeal annulled the decision of the Board of Directors of the Public Authority for Applied Education and Training rejecting the promotion of a faculty member to the rank of associate professor, affirming the illegality of the decision and its legal consequences, thereby restoring the situation to its proper legal standing.

In the reasoning of its ruling, the court underscored the principle that all administrative decisions are subject to judicial review, and that no administrative decision enjoys immunity if it is found to violate the law or contains defects in its legality.

Attorney Mohammed Al-Ansari stated that the judgment embodies the principle of the rule of law, confirming that the administration’s authority in promotion matters is not absolute, but rather subject to administrative judicial oversight to ensure compliance with the law and prevent abuse of power.

He added that the court established, through this ruling, a precedent that the protection of the professional rights of faculty members and other employees is achieved by ensuring that administrative decisions adhere to the principle of legality, thereby guaranteeing justice and safeguarding rights.
