Misdemeanors Court to the Food Authority: Exercise Precision in Drafting Violations - Sarmad

In a landmark ruling by the Misdemeanors Court, following arguments by lawyer Jasem Al-Abduli, the court acquitted the license holder of a company in a case concerning the fitness of food products, emphasizing the importance of exercising precision and caution when reading reports on goods before issuing violations.

The ruling was based on the principle that “there is no crime without a legal text.” The court thoroughly examined the facts and elements of the case, scrutinized the evidence supporting the prosecution, and ultimately concluded that the documents contained no report indicating that the goods in question were unfit.

Lawyer Jasem Al-Abduli stated that after reviewing the case facts and submitted evidence, the court was satisfied that there was insufficient proof to substantiate the charges against his client, and therefore acquitted him of the allegations.

The court highlighted the necessity for those responsible for issuing violations to exercise precision and caution when reviewing reports on any goods before taking steps to issue violations, ensuring that actions are based on verified reports and relevant data.

Al-Abduli noted that the court thoroughly examined the case facts and evidence, and found that the documents lacked any report declaring the goods unfit, which led the court to conclude that the charges were unproven and to acquit the defendant.
