Apple to "Al-Rai": New Lawyers Law Marks a Qualitative and Historic Leap in the Profession's Journey
The President of the Kuwait Bar Association, Adnan Abl, confirmed that the new Law Regulating the Legal Profession has entered its final stages, paving the way for its approval. He considered its enactment a qualitative and historic leap in the profession’s trajectory after decades of legislative delay.
Following Justice Minister and Advisor Nasser Al-Sameet’s disclosure to “Al-Rai” that the Law Regulating the Legal Profession will be issued before the end of this year, Abl told “Al-Rai” in a statement that the new law comes 62 years after the enactment of the previous legislation governing the profession, and nearly 30 years after its last amendment. It aims to redraw the legal framework for legal practice in line with modern developments, enhance the status of Kuwaiti lawyers, and safeguard their rights.
He clarified that the Kuwait Bar Association participated in studying the draft law and submitted a series of concepts and proposals, the most prominent of which include mandatory training courses and written admission exams, securing lawyers’ fees stipulated in contracts and granting them privileged status, and regulating the statute of limitations for professional violations.
The proposals also included stricter penalties for insulting or assaulting lawyers, prohibiting the seizure of a lawyer’s office, and establishing procedural immunity for lawyers through the Code of Criminal Procedure, alongside regulating lawyers’ presence on social media in a manner consistent with the dignity and traditions of the profession.
He noted that the Kuwait Bar Association continues its role as a key partner in developing legislation by providing legal opinions and concepts on draft laws through the “Nahda” initiative and the National Map for Legislative Development.
Abl praised the efforts of Justice Minister and Advisor Nasser Al-Sameet in updating the legislative system, pointing to work on reviewing and amending more than 900 laws as part of the largest legislative movement to modernize laws and keep pace with the requirements of the coming stage.
