A New Judicial Council

A New Judicial Council

We begin by congratulating the new President and members of the Judicial Council, as well as the new Public Prosecutor, on assuming their responsibilities for managing the affairs of the judicial authority, and we pray to God for their success and achievement. It is also important for me to extend our thanks and appreciation to the members of the previous Judicial Council for the roles and efforts they have contributed.

The most important objective of the judiciary is to establish justice in the state and society, and to safeguard rights in general and human rights in particular. God Almighty said: “...and when you judge between people, judge with justice” (Surah An-Nisa, 58). The judiciary and the Public Prosecutor’s Office are an integral part of the state’s judicial authority. Fundamentally, it is an authority that performs constitutional and legal roles, parallel to and in accordance with the legislative authority (the National Assembly) and the executive authority (the Government), as outlined by the Constitution.

I seize this opportunity, through this article, to offer some observations and proposals to support the roles of the new members of the Judicial Council in their upcoming major responsibilities. Perhaps the most important step, after placing our trust in God, is for the new Judicial Council to formulate a strategic action plan for the judicial authority. This plan should evaluate the previous roles of the judicial authority, set strategic objectives and desired outcomes for periods ranging from five to ten years, with emphasis on two key axes: the first being the promotion of justice principles, the protection of human rights, and the preservation of public freedoms in accordance with the principles of Islamic Sharia, the Kuwaiti Constitution, and international conventions ratified by the State of Kuwait; and the second being development, reform, and the enhancement of technical, administrative, and judicial performance in line with international standards.

An important step is to complete what the previous Judicial Council initiated. In February 2025, Advisor Adel Borsly, President of the previous Judicial Council, stated that the Council had conducted a comprehensive study on judicial governance. Therefore, it is crucial for the new Judicial Council to activate this study and work on completing aspects of governance within the judicial authority.

The Judicial Council has an important role in rectifying the status of the Law Regulating the Judiciary, as it stands following the amendments made this year. While the current law contains positive aspects that require activation, there are also aspects that need to be addressed and remedied. For more details, please refer to what we wrote and published on August 23, 2026, under the title “Comments on the Amendment of Some Provisions of the Law Regulating the Judiciary 2026,” on social media platforms.

It is important for the new Judicial Council to prioritize the idea of developing judicial administration, starting from the Judicial Council institution itself to all affiliated and supporting bodies. In the European experience, particularly in Britain, France, and Germany, their Judicial Councils include members with administrative and social specializations that support the roles of the judicial authority. Administration is a crucial field that must be supported to enhance the judicial authority’s functions. It is also acceptable, on a temporary basis, for the technical office to include specialized consultants possessing administrative skills that support plan formulation, governance activation, or the organization of relations with constitutional authorities or other roles.

In the context of the desire to Kuwaitize the members of the judicial corps and the Public Prosecution within a short period, the honorable members of the Judicial Council propose that there be a comprehensive plan for technical, legal, and judicial training. It is imperative not to rely solely on legal skills, as judges and public prosecutors examine, investigate, and deliberate on cases involving the state and society that are linked to social behavior, government decisions, or decisions and actions in the private sector. Therefore, the training for judges and public prosecutors should include courses, lectures, and readings that cover all these aspects, without neglecting communication skills with the public or with entities that interact with the judicial authority or the Public Prosecution. Finally, we ask God for success, correctness, and achievement for the members of the Judicial Council and the new Attorney General, for the benefit of the country, its people, and the judicial authority.
