Subjecting influencers and content creators to licensing

The Cabinet approved the new media regulation law, which includes provisions to govern the activities of influencers, content creators producing advertising content, and digital advertisements directed at the public within Kuwait. Among the law’s key provisions are the requirement for influencers and advertising content creators to obtain licenses, and their obligation to clearly disclose advertising content, whether the advertisement is provided for compensation or free of charge, whenever it is directed at the public within Kuwait. The law also stipulates the establishment of an electronic licensing system to regulate the procedures for obtaining licenses and conducting the media and advertising activities covered by its provisions. The regulation extends to hidden advertisements, reviews, giveaways, contests, as well as content produced using artificial intelligence. The law criminalizes false or misleading advertisements and unlicensed funding aimed at influencing public opinion, as part of establishing clearer controls for advertising and digital content.
