The Court of Appeal upholds the 15-year prison sentence with hard labor and deportation for a Kuwaiti national

Judicial Editor: The Second Division of the Court of Appeal, presided over by Counselor Nasr Al-Haid, upheld the ruling of the Criminal Court, which sentenced a citizen to 15 years’ imprisonment with hard labor, after convicting him of dragging a grocery store clerk to death while fleeing with stolen goods worth no more than two dinars. Case documents indicate that the defendant requested items from a grocery store in the Al-Mutlaa area, then drove away without paying. When the clerk attempted to stop him, the defendant closed the car window on the victim’s hand, dragging him for a distance of approximately 30 meters before leaving him to fall to the ground, succumbing to injuries that proved fatal. The Public Prosecution had initially charged the defendant with intentional homicide and violent theft, but the Criminal Court modified the legal classification to assault resulting in death, sentencing him to 15 years’ imprisonment with hard labor. The Court of Appeal rejected the defendant’s appeal, as well as the Public Prosecution’s objection seeking a harsher penalty, thereby upholding the sentence.
