Minister of Justice: "Economic Circles" Law Establishes Specialized Judiciary and Enhances Investment Environment in Kuwait

Justice Minister and Advisor Nasser Al-Samait confirmed that the law establishing economic courts represents a qualitative leap in Kuwait’s economic justice system, by creating a specialized judiciary across all three levels of litigation, accelerating dispute resolution, developing enforcement procedures, and expanding e-litigation. These measures enhance contract enforcement efficiency and raise confidence in the state’s legal and investment environment.

Advisor Al-Samait told the Kuwait News Agency (KUNA) on Wednesday that the law establishes specialized economic courts at the Court of First Instance, the Court of Appeal, and the Court of Cassation, with jurisdiction over the economic, commercial, and investment disputes specified in the law. These courts will be supported by a specialized technical office to assist their work.

He added that the law aims to expedite case resolution through a case preparation office responsible for completing documentation before cases are presented to the court, as well as by regulating procedural timelines and appeals to minimize the duration of disputes.

He noted that the law introduces a mediation and settlement pathway prior to judicial consideration of disputes, granting settlement minutes the force of an executive instrument, thereby enabling faster and less costly resolution of certain disputes.

He clarified that digital transformation is one of the law’s core pillars, achieved through the adoption of an electronic platform for litigation and enforcement procedures, an electronic case file, and a database of published judgments and judicial precedents.

He pointed out that the law places special emphasis on enforcing judgments by establishing a specialized enforcement administration, linking it electronically to relevant entities, developing attachment procedures, and adopting electronic auctions to ensure swift and effective enforcement.

The Justice Minister stressed that this law supports Kuwait’s competitiveness, enhances its attractiveness for investment, and consolidates the rule of law in economic disputes.

The Cabinet had approved on Tuesday, during its meeting, a draft decree-law issuing the law establishing economic courts, aiming to keep pace with modern global and regional legislation and to harness advanced technological systems in the service of justice.
