Cabinet approves draft decree-law establishing economic circles to align with modern legislation

Kuwait City, 18 August (KUNA) -- The Council of Ministers approved a draft decree-law establishing the Economic Courts, aiming to align with modern global and regional legislation and to harness advanced technological systems in the service of justice. This decision was taken during the Council’s meeting held today, Tuesday, under the chairmanship of Prime Minister Sheikh Ahmad Abdullah Al-Ahmad Al-Sabah.

The decree-law entails enacting legislation to establish the Economic Courts, an procedural law designed to achieve the necessary balance between the right to defense and the swift resolution of cases brought before the courts. This is pursued through three interrelated objectives:

1. Designating an Economic Court, a judge assigned to preside over it, and extending this designation to include the expert appointed to conduct expert assessments in disputes heard by the court, as well as the enforcement judge responsible for implementing its rulings.

2. Simplifying litigation procedures by reducing certain procedural deadlines, preparing cases, notifying parties of the pleadings, and enabling mutual access to memoranda and documents before referral to the competent court. Additionally, the remote litigation system will be activated, while ensuring the principle of adversarial proceedings and safeguarding the right to defense.

3. Ensuring legislative flexibility by avoiding the rigidity of statutory texts, which is considered one of the major flaws of legislation.
