The decision established a committee chaired by Undersecretary Dr. Adel Al-Zamil, with membership comprising individuals deemed suitable by the Ministry based on their expertise and specialization. The committee is tasked with reviewing transfer requests submitted during the specified period, verifying their compliance with the conditions and controls outlined in this decision, and adjudicating them.
The decision clarified that, in order for the committee to consider a transfer request, the employee must submit a transfer application form detailing the reasons and justifications for the transfer, and obtain prior approvals from both the organizational unit from which the employee is being transferred and the unit to which they are being transferred, in accordance with established procedures and without exceeding the receiving unit’s capacity.
The decision also stipulated that the employee’s academic qualification must align with the nature of work at the organizational unit to which they are being transferred, and that the transfer must not disrupt operational needs or result in a shortage of workforce at the unit from which they are being transferred.
Furthermore, the decision specified that approval of a transfer request by the committee must take into account the distance between the employee’s residence (as registered on their civil ID) and their current workplace, as well as the receiving organizational unit. Additionally, the transfer decision must not result in any additional financial allowances that are not considered part of the salary, such as shift allowances or remote area allowances.
It was noted that, in exceptional cases assessed based on documented reasons and justifications, the committee may recommend approving a transfer request in light of specific humanitarian, social, or functional considerations, provided that the interests of the service are respected, in a manner that does not contravene the aforementioned clause. Compliance with the mentioned conditions and controls does not confer an automatic right to transfer.
The decision clarified that transfer requests that do not include the required data and documents, or that are submitted after the deadline specified in Article One, will not be considered.
It was indicated that employee transfer decisions will be issued in 2027, following the completion of the annual performance evaluation for the year ending in 2026 for the employee being transferred.
The decision stated that it takes effect from the date of its issuance, with adherence to the deadlines set forth in Article One, and that all relevant authorities within the Ministry are required to implement it and notify those concerned.
