Justice Ministry issues executive regulations on notarization, permitting remote notarization and attestation
The official gazette, Al-Kuwait Al-Youm, published in its issue No. 1809 the Ministry of Justice’s Decision No. 590 of 2026, which issues the Executive Regulations for Law No. 10 of 2020 concerning notarization, as amended by Decree-Law No. 147 of 2025. The regulations permit the performance of notarization and attestation services remotely via video conferencing and an automated electronic system, provided that the concerned parties possess a protected electronic signature. Three exceptions are excluded from this requirement, the most notable being individuals aged 75 years or older.
2. Possess full legal capacity, whether as a natural person, a manager of a professional company, or a partner therein.
3. The natural person, the manager of the professional company, its partners, and the employees engaged in performing notarization services must hold a law degree or an equivalent qualification from a certificate recognized by the Ministry of Higher Education.
4. The individuals mentioned in the preceding two items must be of good conduct and reputation. No final conviction for a felony, a crime involving breach of honor or trust, a crime against the dignity of the Amir, terrorism, or state security may have been issued against any of them, unless their civil rights have been restored. Additionally, none of them may have previously been dismissed on disciplinary grounds.
5. Successfully complete the prescribed training programs and examinations, except for those who have previously held the position of a government notary for a period of at least ten years.
6. Possess practical experience in legal affairs for a period of at least ten years.
8. Submit a valid insurance policy, maintained throughout the duration of the license, covering liability for professional errors, issued by one of the insurance companies licensed in the State of Kuwait, with an annual coverage amount of no less than one hundred thousand Kuwaiti dinars.
