Justice: Mechanism for Signing Contracts of Employees Whose Nationalities Have Been Revoked
The Ministry of Justice issued a mechanism to regulate the procedures for signing contracts for employees whose citizenship has been revoked. This mechanism specifies the eligible categories, contract durations, review deadlines, and required documents. It stipulates that salaries will be suspended provisionally for those who fail to complete the procedures within the specified period, and it becomes effective from the date of its issuance.
According to a circular issued yesterday, addressed by the Ministry’s Administrative Affairs Department to department directors and all organizational units, and obtained by Al-Jarida, the mechanism covers four categories: Article Eight, Article Five (Meritorious Services), Article Five (1965 Census and its amendments), and Article Five, Paragraph Two (Children of Kuwaiti women).
The circular mandates all covered employees to visit the Administrative Affairs Department to complete the procedures for signing or renewing their contracts. Contracts for employees in the Article Eight category will be for two years, with renewal procedures to be completed at least one month before expiration, in accordance with established regulations. Contracts for all other covered categories will be for one year, renewed annually, with renewal procedures to be completed at least one month before the contract expires.
Regarding the "Children of Kuwaiti women" category, contracts will be signed immediately upon receipt of the contract form from the competent authorities, and they will continue to work in accordance with the relevant Council of Ministers circular.
The circular emphasized that if an employee fails to visit the department within the specified period, the Ministry will take the prescribed administrative and financial measures, including the provisional suspension of salary, until the procedures for signing an engagement contract or renewing contracts are completed.
For employees against whom decrees revoking citizenship have been issued, the mechanism requires those who have not yet applied to complete contracting procedures by the date of issuance to visit the Administrative Affairs Department – End of Service Section at the Ministries Complex within a maximum of one month. All employees are required to visit the Ministry immediately upon the issuance of any future decrees or decisions regarding the revocation of Kuwaiti citizenship, provided the revocation falls within the aforementioned categories, within a maximum of one month to finalize contracting.
The mechanism specified the required documents for review in case of initial contracting, emphasizing that failure to review within the specified period grants the Ministry the right to take measures permitted by the laws, regulations, and decisions governing this matter. Compliance with the mechanism is a condition for the continued payment of financial entitlements.
The mechanism also mandates employees whose job titles have been changed, who have obtained new academic qualifications, or whose work status has been changed from the aforementioned categories, to visit the Administrative Affairs Department to sign a new contract containing their updated job details, within a maximum of one month from the date of the decisions involving any modification or change.
Regarding the extension of insurance coverage, the mechanism requires employees whose Kuwaiti citizenship was revoked and who have reverted to their original citizenship of a Gulf Cooperation Council (GCC) country to immediately comply with the provisions of Public Authority for Social Insurance Circular No. 5 of 2025. They must visit the Administrative Affairs Department headquarters within a maximum of one month to be re-registered in the insurance coverage extension system following the revocation of their Kuwaiti citizenship.
