The Council of Ministers issued a draft decree-law to regulate the judiciary in the State of Kuwait, following a review of the Constitution and relevant laws, and based on a proposal from the Minister of Justice and the Council’s approval. The draft includes several key articles aimed at restructuring the judicial authority, ensuring its independence, and enhancing its performance.

Article 6: Judges and members of the Kuwaiti Public Prosecution appointed prior to the issuance of this law shall continue in their positions until the end of their service, with the possibility of transfer between the judiciary and the prosecution.

Article 11: The Prime Minister and ministers are tasked with implementing the law and putting it into effect from the date of its publication in the Official Gazette.

Court of Cassation: It is headed by a President and a Vice President, along with a number of counselors. Its judgments are issued by five members. A body is also established to unify legal principles in cases of conflicting judgments.

Court of Appeal: It consists of a President, a Vice President, and counselors. Its judgments are issued by three members.

Court of First Instance: It is headed by a President, Vice Presidents, and a number of judges. Its judgments are issued by three judges, unless the law stipulates that they be issued by a single judge.

Summary Courts: These are established in each governorate by a decision of the Minister of Justice, and their judgments are issued by a single judge.

Decisions of the General Assembly are issued by an absolute majority. In the event of a tie, the vote of the President prevails.

A committee for urgent matters is formed in each court to handle urgent issues when the General Assembly cannot convene.
