Fatwa and Legislation: Developing International Legal Frameworks to Support Investment and Dispute Settlement

The Legal Opinions and Legislation Department affirmed Kuwait’s commitment to continuing its active contribution to the development of international legal frameworks, thereby enhancing legal certainty, supporting trade and investment, facilitating dispute settlement, and keeping pace with global developments. This was stated by Highness Dr. Aisha Al-Sabah, Legal Advisor at the Legal Opinions and Legislation Department, in an interview with KUNA yesterday evening, as she chaired the country’s delegation participating in the 59th session of the United Nations Commission on International Trade Law (UNCITRAL), held at the United Nations Headquarters from June 29 to July 10.

At the conclusion of the session, Legal Advisor Al-Sabah said that the Commission finalized the draft statute of the Advisory Centre on International Commercial Dispute Settlement and recommended that the UN General Assembly consider adopting the statute, while authorizing the Commission to continue its deliberations on the Centre’s headquarters, with a view to submitting a recommendation to the General Assembly in 2027, taking into account potential host locations.

She added that the Commission also adopted the final text of the supplementary rules governing the conduct of international commercial dispute settlement proceedings, following the completion of deliberations on the matter.

She noted that during the second week of the session, the Secretariat presented its work programme, which included the United Nations Convention on the Use of Electronic Communications in International Contracts, to be opened for signature in October next year.
