Kuwait's Arbitration Law regulates the procedures for resolving commercial and civil disputes through selected arbitrators
Translated by Qiyas from الأنباء — Original source
Arbitration is a legal mechanism for resolving disputes between individuals or companies, whereby the parties agree to refer their dispute to an arbitrator or an arbitral tribunal instead of resorting directly to the courts. The Arbitration Law aims to regulate arbitration procedures, define the rights and obligations of the parties, govern the work of arbitrators, and ensure the issuance and enforcement of arbitral awards in accordance with the law. Among the key advantages of arbitration is that it provides an organized and flexible means of dispute resolution, and it is particularly used in commercial and civil disputes. In the State of Kuwait, the law regulates arbitration procedures and sets out the rules governing arbitration agreements, arbitral tribunals, and the awards issued by them. I conclude my article by emphasizing that arbitration is an important legal tool that facilitates the organized resolution of disputes while safeguarding the rights of the parties and ensuring compliance with the law.
