The Commercial Circle annuls the sale of a luxury watch and orders the seller to refund 92,500 dinars

The Commercial Division of the Court of Appeal ruled to annul the sales contract for a luxury wristwatch and ordered the seller to refund the buyer 92,500 Kuwaiti dinars, after it was established that the watch did not conform to the agreed specifications and model at the time the deal was concluded.

The buyer had filed a lawsuit, explaining that he purchased a valuable watch with specific guarantees and specifications, but later discovered fundamental discrepancies between the watch and the agreed-upon specifications. This prompted him to seek judicial recourse to demand the annulment of the contract and the recovery of the paid amount.

Following the initiation of legal proceedings and the appointment of a technical expert, the court adopted the findings of the expert report and ruled to annul the sales contract, ordering the seller to refund the full value of the watch, amounting to 92,500 dinars.

The buyer’s representative, lawyer Mohammed Al-Shabily, affirmed that the judgment aligned with the expert report, which confirmed that the disputed watch did not match the agreed specifications. He pointed out that the watch’s model and manufacturing year were proven to be different, in addition to the fact that it had been opened by an unauthorized party, which affected its warranty and technical condition.

He added that the judgment reinforces the principle of holding sellers accountable for delivering goods that conform to the agreed specifications and essential characteristics, thereby safeguarding the rights of parties involved in high-value transactions.
