Financial Supervision Authority: Registration of the Government Medical Malpractice Insurance Fund
Cairo - Nihad Imad: The General Authority for Financial Supervision, chaired by Dr. Islam Azam, has approved the registration of the “Government Fund for Insurance Against Risks Arising from Medical Errors” in the register of government insurance funds maintained by the Authority. This comes in parallel with the approval of the regulations governing the insurance operations covered by the Fund, which clearly define the scope of coverage, eligible categories, and insurance premiums, thereby enhancing the efficiency and sustainability of the medical malpractice insurance system.
The registration of the Fund falls within the framework of enforcing the provisions of the Unified Insurance Law and the Law Regulating Medical Liability and Patient Safety, and implementing the Prime Minister’s decision to establish the Fund’s statute, in compliance with the laws, decisions, and executive controls issued by the General Authority for Financial Supervision.
Azam emphasized that registering the Government Fund for Insurance Against Risks Arising from Medical Errors and issuing the regulations governing the insurance operations it covers represents a significant step in activating the insurance system linked to medical liability. This provides a clear and fair framework for protecting the rights of medical service recipients, while also safeguarding the interests of medical professionals and health facilities.
He clarified that when drafting the regulations governing the insurance operations covered by the Fund under Decision No. (303) of 2025, the Authority sought to achieve a balance between providing effective insurance protection and ensuring the financial sustainability of the Fund. This was achieved by relying on actuarial studies to determine premiums and review them based on actual experience, alongside establishing clear guidelines for coverage and compensation disbursement mechanisms.
The Authority specified the annual premiums for natural persons who are members of medical professions, based on the nature of the profession and the specialization level. The annual premium for human physicians is 240 Egyptian pounds for the general practitioner level, and 920 Egyptian pounds for other specialization levels. The annual premium for dentists, physical therapy practitioners, and specialists is 160 Egyptian pounds for the general practitioner level and 400 Egyptian pounds for other specialization levels. For pharmacists, the premium is approximately 240 Egyptian pounds, and 100 Egyptian pounds for other licensed categories practicing a medical profession. A 25% discount on the annual premium is granted during the first licensing period for recent graduates.
The decision also set the annual premiums for medical facilities at 24,000 Egyptian pounds for hospitals with no more than 50 beds, with an additional 500 Egyptian pounds for each extra bed. The premium is 9,600 Egyptian pounds for medical centers, 3,600 Egyptian pounds for radiology centers, 2,400 Egyptian pounds for laboratory centers, and 1,200 Egyptian pounds for pharmacies.
The Authority mandated the Fund’s Board of Directors to appoint one of the registered actuarial experts to prepare an actuarial study based on actual experience accumulated during the Fund’s first three years of operation, with the option to conduct studies whenever necessary. This ensures price reviews and the determination of appropriate premium levels in light of actual results.
The Fund is responsible for providing insurance coverage and compensating beneficiaries for cases of death, disability, or physical injuries resulting from medical errors, in accordance with the provisions of the insurance policy issued by the Fund, whether directly through the Fund or by contracting with one or more insurance companies or an insurance pool approved by the Authority.
