Smart Home Parking for Vehicles

The Official Gazette, “Kuwait Today,” published the Ministry of Interior’s Decision No. 1090 of 2026 concerning the smart home detention of vehicles. Article One of the decision defined smart home detention as the detention of vehicles at the owner’s residence under their custody, utilizing the latest modern technological means and in accordance with the regulations set by the General Directorate of Traffic.

Article Two stipulated that the General Directorate of Traffic may apply smart home detention to violations listed under Article 207 of Ministerial Decision No. 81/1976. Additionally, upon request by the owner of a vehicle detained by the Directorate, the vehicle may be detained at home in accordance with the specified regulations, achieved through a device installed in the vehicle subject to home detention.

Article Three set the fees at an additional charge of 10 dinars if the owner of the violating vehicle requests home detention and a detention officer travels to the home to install the device. This fee applies per vehicle if multiple violating vehicles are involved. Furthermore, the General Directorate of Traffic collects a fee of 2 dinars for each day for the smart home detention service.

The Ministry of Interior also issued a decision adding a new item (4) to paragraph “ninth” of Article 39 of Ministerial Decision No. 2249/2025, which establishes a fixed fee of 150 dinars for the service of converting an entry visa into a standard residence permit, in accordance with the provisions of Article 16 of the decision. This fee excludes domestic workers and those in the same category, as per Article 20 of the same decision.

For further details: The decision obligates the vehicle owner not to tamper with the device and to return it immediately upon the expiration of the detention period, with penalties for violators. The Ministry of Interior outlines the mechanism for smart home detention of vehicles: 10 dinars for installation and 2 dinars daily.

Article One of the decision defined smart home detention as “detaining vehicles at homes under the custody of their owners according to the latest modern technological means and in accordance with the regulations determined by the General Directorate of Traffic.”

Article Two stated that the General Directorate of Traffic may apply smart home detention to violations listed under Article 207 of Ministerial Decision No. 81/1976. It also allows, upon request by the owner of a vehicle detained by the Directorate, for the vehicle to be detained at home according to the specified regulations, accomplished via a device installed in the vehicle to be detained at home.

Regarding fees, Article Three of the decision set an additional charge of 10 dinars if the owner of the violating vehicle requests home detention and a detention officer travels to the home to install the device. This applies per vehicle if there are multiple violating vehicles, in addition to the General Directorate of Traffic collecting a fee of 2 dinars per day for the smart home detention service.

Article Four outlines five obligations imposed on the owner of a detained vehicle:

- Not to tamper with, break, or damage the device.

- Paying the value of the device according to the contract signed between the Ministry of Interior and the supplying company in case of tampering or damage.

- Not moving the vehicle except within the limits, conditions, and regulations approved by the General Directorate of Traffic at the time of device installation.

- Returning the device to the Directorate the day after the scheduled detention period ends.

- Notifying the Directorate in case of any malfunction in the device.

Article Five stipulated the application of the provisions of Article 34 of Law Decree No. 67/1976 to anyone violating the rules and provisions of this decision. Article Six tasked the Deputy Minister with implementation.

The decision takes effect from the date of its publication in the Official Gazette.
